Assisted dying is in the spotlight on both sides of the Atlantic.
In Britain the House of Commons approved a euthanasia bill. In the U.S. a bereaved family brought to trial the first case of wrongful death during Covid.
The family of 19 year-old Grace Schara, who had Down syndrome, filed a civil wrongful death lawsuit against Ascension St. Elizabeth Hospital, of Appleton, Wisconsin, claiming the doctors and nurses violated her rights by listing her as "do not resuscitate" (DNR) without the family's consent and giving her a lethal cocktail of drugs that led to her death.
After a two-hour deliberation the jury sided with the hospital, Dr. Gavin Shokar and nurse Hollee McInnis.
Although the jury sided with the hospital, the case successfully publicised the fate not only of Grace but of many others. The three-week trial was live-streamed and followed by millions.
I cannot say if Grace was independent but she was by all accounts a vivacious and outgoing person, actively involved with her church, and by the metric that we are told is the only one that matters, contributed to her community.
Nonetheless, the State killed her.
Side thought: is contributing to your community the same as "the greater good"? Think long and hard about that because the riddle contains the answer. You might even say it is “the Ultimate Question of Life, the Universe, and Everything."
Her parents took Grace to hospital on Oct 7, 2021, after she displayed flu-like systems and tested positive for Covid using a home testing kit.
Like hundreds of millions around the world they listened to the television and did what governments told them... almost.
The doctor said she had low oxygen levels and a day later said she would be placed on a ventilator.
Her father, Scott, had an oxygen saturation meter. He found that her oxygen levels had recovered to a healthy 95 per cent and a nurse agreed.
The next day he was escorted out of the hospital, her sister Jessica taking his place.
Grace's recovery was interrupted when the doctor increased her dose of the Pfizer sedative Precedex (dexmedetomidine) by 14 times on the morning of October 13, followed by three doses of Lorazepam in the afternoon, followed that evening by morphine.
Then, in a vignette of the dark side of medicine, the Dr. Gavin Shokar called her parents to report that "Grace had a good day."
As the palliative drugs slowed her pulse, her sister Jessica, acting as her advocate, begged staff to save Grace, but they declined and pointed to the DNR order.
The parents rushed to the hospital but an armed guard stood outside the room. "So we watched her die on FaceTime."
Complicity
The DNR was ordered by the doctor on the October 13th less than 10 minutes after he increased her dose of Precedex. He should have contacted her mother, Cindy, who had power of attorney. He could have asked her to sign it.
Her father, Scott, asks:
"Was the DNR put on Grace eight minutes after the maximum dose of Precedex because they thought she would be taken out then? An attorney who reviewed the timing of the DNR said he believes the doctor thought the Precedex would take Grace out, so he needed the DNR in place to accomplish their goal — which was to kill her."
The Scharas' lawyer Warner Mendenhall said the U.S. has a real problem with informed consent before the use of powerful drugs that can kill. The hospital did not inform the family what drugs they were giving or the risks, nor seek consent for a DNR.
The issue is not about Covid but extends to the hospital system.
Grace's records said that she agreed to waive her rights when she was admitted in October 2021 with Covid-19, at a time when her father was with her in the hospital and knows that was a lie.
Worse, doctors declared her to be deaf due to conductive hearing loss — another lie but it was their excuse not to speak to her. When she asked to go to the toilet she was "chemically restrained."
This decision, that Grace's voice did not count — "no-one can hear you cry" — is one of the most troubling aspects of the case. It recalls the Soviet Union sending dissidents to psychiatric wards - psikhushkas, hush now - which silenced them while painting them as insane.
Bureaucratic deficit
This is the bureaucracy depriving the individual of their voice if it interrupts or interferes with "policy."
Grace was a young lady with Down syndrome. If the authorities deemed it necessary to silence her how, by the same token, will they deal with dissidents?
Silencing people works both ways. The authorities don't want to know.
Her mother Cindy Schara said, "If the nurses and doctors had got to know Grace, they would have been blessed beyond their wildest dreams. They chose to take her out instead and not even get to know that special girl."
